Terms of service
Last updated: September 25, 2026
1. Who we are and what these terms cover
Kinetic Carving LLC, a Tennessee limited liability company ("Kinetic Carving", "we", "us"), runs kineticcarving.com and its related sites and tools, including the subdomains at kineticcarving.com (together, the "Service"). These Terms of Service ("Terms") are a binding agreement between you and us. They cover everything you do on the Service: browsing, buying design files or physical items, becoming a member, using credits, using our tools, and listing or finding a maker in the Maker Directory. The following documents are part of these Terms, and each controls for its own subject if it conflicts with this page:
- the Subscription Policy
- the File License
- the Refund Policy
- the Maker Directory Terms
- the Tools Terms
- the Privacy Policy
By using the Service or making a purchase, you agree to these Terms.
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract to buy from us, become a member or list in the Maker Directory. You are responsible for your account and for keeping your sign-in private. Accounts and memberships are for one person. You may not share, sell or transfer your account, membership or credits.
3. What we sell
(a) Digital design files (such as SVG, STL, PNG and related formats), delivered by download.
(b) Apparel, such as T-shirts, printed on demand and shipped by our print provider, Printify.
(c) The Kinetic Carving membership, an automatically renewing subscription that includes download credits and member benefits (see the Subscription Policy).
(d) Credit packs, available to active members only.
Product pages describe what each item includes. Some listings may not yet include every file type described. Where that is the case, the listing shows a notice, and we will supply a missing file type on request.
4. Prices, payment and taxes
Prices are in US dollars and shown at checkout. Payments are processed by Shopify and its payment partners. We never see or store your full card number. You authorize us and our payment processor to charge your chosen payment method for your purchases, including recurring membership charges, until you cancel. You are responsible for any applicable taxes shown at checkout. We may correct pricing errors and may cancel an order placed at an obviously incorrect price, refunding any payment.
5. Digital delivery
Files are delivered digitally as soon as payment completes, or when you spend credits. Download links are time-limited for security. Files you have obtained stay available to download again from your account, free of charge, including after a membership ends, for as long as we operate the Service. Keep your own copies of files you rely on.
6. License to use our files
Files are licensed to you under the File License. They are not sold. Kinetic Carving and its licensors own all rights in the designs. Any use outside the File License is not permitted.
7. Membership, credits and automatic renewal
The membership renews automatically until you cancel. The Subscription Policy explains the price, the billing schedule, how credits work and how to cancel. Read them before you subscribe.
8. Partner discounts
Membership may include a discount with a partner company, currently High Country Tools. Partner discounts are provided at our discretion and the partner's. They can change or end, and they have no cash value. Anything you buy from a partner is between you and that partner. The Privacy Policy explains the limited information we share to issue your code.
9. Tools and guides
Our tools (including KERF, CHIP, Kinetic Laser Studio and the Job Pricing Tool) are governed by the Tools Terms. Tools are provided for guidance and estimates only. You are responsible for safe machine operation and for your own pricing and business decisions.
10. Maker Directory
The Maker Directory lists independent makers. They are not our employees, agents or partners. We do not take part in, supervise or guarantee any job arranged through the directory. The Maker Directory Terms apply to makers who list and to anyone who contacts them.
11. Your content and feedback
If you submit content to the Service, you give us a non-exclusive, worldwide, royalty-free license to host, display and use it to run and promote the Service. This covers maker listings and photos, reviews, feedback and questions. You confirm you have the right to submit it. If you send us ideas or feedback, we may use them without owing you anything.
12. Rules of use
You agree not to:
- share, resell, upload or distribute our files, or your access to them;
- get around download limits, credit costs, membership gates or security measures;
- scrape, copy or bulk-download the catalog, or use automated means to access the Service except through our published interfaces;
- use our files, images or catalog to train or build machine-learning or image-generation systems;
- misuse the Maker Directory, including false listings, harassment, spam or fraud;
- break any law or anyone else's rights.
13. Our intellectual property; third-party names
The Service, our designs, images, text, logos and the Kinetic Carving name belong to us or our licensors. We mention software and machine brands (for example LightBurn, Glowforge, Vectric, Carbide 3D, Aspire and Inventables) only to describe compatibility. We are not affiliated with or endorsed by those companies. Designs that depict military units, government agencies, public services or other organizations are tribute artwork. Kinetic Carving is not affiliated with, sponsored by, or endorsed by the U.S. Department of Defense, any branch of the U.S. Armed Forces, any government agency, or any law enforcement agency. You are responsible for making sure that what you make from a design, and how you use or sell it, complies with the law where you are, including any restrictions on reproducing official insignia, badges or seals.
14. Safety
CNC routers, lasers and 3D printers can cause fire, injury and property damage. Any settings, speeds, feeds, toolpaths or techniques in our files, guides or tools are general starting points, not instructions for your machine. Follow your manufacturer's safety guidance, never leave a running machine unattended, and test on scrap material. You use our files, guides and tools at your own risk.
15. Disclaimer of warranties
To the fullest extent permitted by law, the Service, files, tools and guides are provided "as is" and "as available", without warranties of any kind, express or implied. This includes merchantability, fitness for a particular purpose, non-infringement, and accuracy of any estimate or setting. Some states do not allow these exclusions, so some may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law:
- Kinetic Carving and its members, managers, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or materials.
- Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100.
These limits do not apply where the law does not allow them, for example liability for our own fraud or for death or personal injury caused by our negligence.
17. Indemnity
You agree to defend and indemnify Kinetic Carving against claims, losses and costs (including reasonable attorneys' fees) arising from any of the following:
- your breach of these Terms or the File License;
- items you make or sell using our files;
- your listing in the Maker Directory, or work you perform for others;
- your violation of any law or third-party right.
18. Disputes: informal resolution, then individual arbitration
(a) Talk to us first. Before starting any claim, email contact@kineticcarving.com with a description of the issue and the outcome you want. Both sides will try in good faith to resolve it within 30 days.
(b) Arbitration. If it isn't resolved, any dispute arising from these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration takes place by video or phone, or in the county where you live. The Federal Arbitration Act governs this section. Either side may instead bring an individual claim in small-claims court if it qualifies. Either side may also ask a court to stop infringement or misuse of intellectual property.
(c) No class actions. You and Kinetic Carving each agree to bring claims only in an individual capacity, never as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate claims.
(d) Opting out. You may opt out of this section within 30 days of first agreeing to these Terms by emailing contact@kineticcarving.com with your name and the words "arbitration opt-out".
(e) If the class-action waiver is found unenforceable for a claim, that claim goes to court, not arbitration, and the rest of this section still applies.
19. Governing law and venue
Tennessee law governs these Terms, without regard to conflict-of-law rules. Any court proceeding allowed by these Terms will be brought in the state or federal courts serving Montgomery County, Tennessee. Nothing in these Terms takes away any right you have under the consumer protection laws of the state where you live.
20. Suspension and termination
We may suspend or end your access, including your membership, if you seriously or repeatedly break these Terms. This includes sharing files or accounts, fraud and chargeback abuse. If we end a membership for any reason other than your breach, we will refund the unused part of the current paid period. You may stop using the Service at any time. Sections that by their nature should survive (license limits, disclaimers, liability limits, indemnity and disputes) survive termination.
21. Changes to these Terms
We may update these Terms. For material changes we will update the date above and, for members, email notice before the change takes effect. Continuing to use the Service after that date means you accept the updated Terms. A change never applies retroactively to a dispute that has already arisen. Price changes to a membership follow the notice rules in the Subscription Policy.
22. General
These Terms are the entire agreement between us on their subject. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms. We may transfer them as part of a sale or reorganization of the business. Neither side is responsible for delays caused by events beyond its reasonable control.
